01 — Who processes your data

It depends on where you are.

European Union and Spain: Montek Technologies S.L., based in Barcelona, Spain. NIF [NIF].

Mexico and the United States: Montek Technologies LLC, based in Scottsdale, Arizona, United States.

In both cases, for any privacy matter: privacy@montek.ai.

02 — What data we collect and why

Contact forms and WhatsApp. Name, email, phone number and whatever you tell us. We use them to respond to you and propose a solution. Legal basis: pre-contractual measures at your request and legitimate interest in handling your inquiry (Art. 6.1.b and 6.1.f GDPR).

Browsing. IP address and site usage metrics. We use them to keep the site running and to improve it. Legal basis: your consent via the cookie panel (Art. 6.1.a GDPR).

Use of our products. Identification data, credentials and billing information from those who contract a service. We use them to give you access, operate the service and comply with tax obligations. Legal basis: performance of contract (Art. 6.1.b GDPR).

We don't collect more than we need, and we don't use your data to train artificial intelligence models.

03 — How long we keep them

Inquiries and forms: as long as needed to assist you, or until you ask us to delete them. Contract and billing data: for the duration of the service and, afterward, the period required by applicable commercial and tax law (between 5 and 6 years in Spain). Browsing data: as specified in the Cookie Policy.

04 — Who we share them with

We do not sell or transfer your data. To operate we use infrastructure providers (hosting, databases, payment gateways and messaging, including Meta's WhatsApp Business API) that act as data processors under contracts in accordance with Art. 28 GDPR. They only have access to what is strictly necessary for their function.

05 — Transfers outside the European Union

When Montek Technologies S.L. uses providers that process data in the United States, it does so with recognized safeguards: adherence to the EU–U.S. Data Privacy Framework or standard contractual clauses approved by the European Commission.

06 — Your rights

You can ask us to access, correct, delete, restrict, port or object to the processing of your data. Write to privacy@montek.ai with the subject "Privacy rights" and a document proving your identity. We respond within the legal timeframe (one month in the EU). If you believe we didn't handle your request properly, you can file a complaint with the Spanish Data Protection Agency at www.aepd.es.

07 — If you are in Mexico or the United States

In these countries the data controller is Montek Technologies LLC.

Mexico. We process your data in accordance with the Federal Law on Protection of Personal Data Held by Private Parties (LFPDPPP). You have ARCO rights (access, rectification, cancellation and opposition) and can exercise them at the same email. The competent authority is INAI.

United States. If you are a California resident, the CCPA/CPRA grants you the right to know what data we hold, to delete it and to opt out of its sale. We do not sell personal data. Exercise your rights at privacy@montek.ai.

If we update this notice, the current version will always be on this page with its date.
